Terms and Conditions of Taj Reisen :
All bookings are accepted only on the basis of the General Terms and Conditions printed below. If bookings are made by phone, online or in writing, the customer expressly agrees to these General Terms and Conditions.
1. Conclusion of the travel contract
The registration can be made in writing, verbally, by telephone or via online services. It is carried out by the applicant for all participants listed in the application for whose contractual obligations the applicant is responsible as well as for his own responsibilities, provided that he has accepted a corresponding obligation using an explicit and separate declaration. You are bound to your booking until acceptance by us, but no longer than 16 days from the date of registration. The recognition of the booking becomes binding for us only by a written confirmation from us.
2. Payment and delivery of travel documents
Within one week after receipt of the confirmation of travel/invoice, please transfer the deposit shown on the travel confirmation/invoice. This implies 25%, but at least € 100 of the total price of the bill. The remaining payment must be made no later than 60 days before departure without further request. Other payment terms of individual trips are possible, the exact deposit & final payment conditions can be found on the travel confirmation. Your payments made on the travel price are insolvency-secured under § 651 k German Civil Code. The security certificate will be sent to you together with the travel documents (only for tour packages).
Airline tickets, which are subject to separate conditions, sometimes require immediate payment and ticketing. Please note the respective regulations. If the agreed down payment amount or travel price until the start of the trip is not paid in full even after notice of default, this entitles us to dissolve the travel contract and to calculate compensation in the amount of the corresponding cancellation fees, provided that there is at this time not a defect of travel.
3. Services, subsidiary agreements
The range of the contractual services results from the service description as well as from the information referring to that in the travel confirmation. Additional agreements (changes, additions, special requests, etc.) require expressly written confirmation from Taj Reisen.
4. Scheduled Arline flight services
For tax reasons, we point out that, as far as included in the package arrangement scheduled flights, Taj Reisen does not occur as an organiser. These air services are organised and operated by the airlines on their sole responsibility and are only communicated by us. Your rights and obligations as a customer towards the airlines are governed exclusively by the agreements made with the airline, in particular, business or transport conditions. This does not change the fact that we are of course responsible for the whole tour with flight contractual as the organiser.
5. Price Increases
Price increases due to circumstances that occurred only after the confirmation of travel and were not foreseeable can be charged to the customer if between travel confirmation and the start of the journey are more than four months, details of the calculation of the new price, at least three weeks before. The change in price reflects an increase in the cost of transport for specific services such as port or airport charges or a difference in the exchange rates applicable to the trip in question. Price increases will be communicated to the customer immediately after becoming known. In case of price increases, the customer is in principle free to withdraw. All payments made to the organiser will be refunded.
6. Resignation or change of booking by customer
The customer is entitled to withdraw from the contract at any time before departure. Certain is the time of receipt of the cancellation notice at Taj Reisen. The declaration by registered mail is recommended. In case of withdrawal, Taj Reisen is entitled to reasonable compensation under § 651 I German Civil Law. Decisive for the calculation of the compensation is the time of the start of the first contractual service when booking a tour package, so the booking of several compiled individual services. This date also applies to all other services as travel date. As far as stated in the different travel descriptions, our claim for cancellation fees amounts to:
6.1 Arrangement from scheduled airline flights
The estimated cancellation fees can be found in the details on your confirmation/invoice. The cancellation fees after ticketing are at least € 150, maximum 100% of the price. This clause to point 6.1 applies even if the passenger does not reach the flight in time, is excluded from the trip due to incomplete travel documents or violation of the visa regulations or the flight destination or flight routing is changed before departure.
6.2 Tour Packages
Cost per Person for cancellation:
– Up to and including 60 days before departure 30% of the travel price, min. € 100 per person
– 59-31 days before departure 50% of the travel price, min. € 100 per person
– 30-15 days before departure 85% of the travel price, min. € 100 per person
– 14-1 days before departure 90% of the travel price, min. € 100 per person
From the start of the journey the entire price.
In the event of non-arrival of the journey or non-take-up of the services, the full travel price must be paid. Expenses saved will be refunded. As far as services are not listed, the calculation takes place acc. § 651 I German Civil Law. Please also note the corresponding information in the service description.
In the event of cancellation of the following destination services, special / deviating costs amount to up to 100%:
– Transfers or public transport tickets
– Theatre tickets, entrance tickets and excursion programs
– Other cancellation policies for tours are possible; the exact cancellation policy can be found on the travel confirmation.
6.3 Exceptions for group tours
For group tours, special cancellation fees can be charged. If the withdrawal falls below the minimum group size, the cancellation costs are 100%.
6.4 Change of booking
Change of bookings are treated as cancellations and rebookings.
7. Substitute person
Until the beginning of the journey, the customer can request that instead of himself a third party can take part in the trip unless there are particular reasons for doing so. We charge a processing fee of € 150, – per person for a change of person. Insofar as the service providers incur further costs as a result of the evolution of persons (in particular changes in flight bookings), these costs are passed on further.
8. Assignment prohibition
The assignment of any claims of the traveller on the occasion of the trip, for whatever legal reason, to third parties – including spouses – is excluded.
9. Resignation because of not reaching the number of participants
If a minimum number of participants specified regarding reference is not reached, Taj Reisen is entitled to withdraw from the contract. The withdrawal can be declared at least three weeks before departure. Already paid payments will be refunded immediately. Also, any costs incurred by the booking will be reimbursed to the customer, unless he makes use of a replacement offer.
10. Warranty / Remedy
If, in your opinion, the journey is faulty, please contact your travel guide or the contact address provided with the travel documents immediately so that remedial action can be taken. If the notification of defects does not occur on site, this may mean that you can not claim for these defects (reduction, compensation for damages). Regardless of the on-site notification of the error, you must expressly assert any claims for reduction/compensation within one month of the contractually agreed end of the trip. If you decide on the spot to cancel the trip due to existing deficiencies, you must first indicate the defect in this case on the tour guide and set a reasonable time for elimination first, so you do not lose further claims. This obligation does not exist only if the remedy is impossible, this is denied, or immediate termination of the contract by a particular interest of the customer is justified.
11. Changes on-site
If you change your holiday plan on-site and thereby do not entitle any services booked with us, please inform your tour guide immediately or contact the agency, so that at least a part of yours for this Services incurred travel price can be refunded. Please note that in all these cases, only that can be reimbursed by us, which was not charged to us by the non-use of the services of the respective service provider.
12. Limitation of liability
Insofar as the damage has been caused neither intentionally nor grossly negligently by the organiser or the operator is solely responsible because of a fault of a service provider, the liability for damage, which is not physical damage, is limited to three times the travel price. Claims based on tortious liability remain unaffected.
13. Passport, visa and health regulations
The tour operator is responsible for informing nationals of the state in which the travel is offered about the provisions of passport, visa and health regulations, as well as their possible changes before departure. The responsible consulate provides information for nationals of other states. The tour operator is not liable for timely issuance and the receipt of necessary visas by the respective diplomatic representation if the traveller has instructed the tour operator with the procurement unless Taj Reisen was responsible for the delay. The traveller is responsible for complying with all regulations that are important for implementation. All disadvantages, in particular, the payment of cancellation fees, resulting from non-compliance with this provision are at the expense of Taj Reisen, except in the case of culpable misinformation or non-information. The traveller should inform himself in good time about infection and vaccination protection as well as other prophylactic measures; if necessary, medical advice should be sought. Reference is made to general information, in particular to health authorities, physicians experienced in travel medicine, tropical medicine, travel medical information services or the Federal Center for Health Education.
14. Flight Schedule
As far as Taj Reisen announces flight times, this is subject to the change on the part of the airline. Please note that even after the flight ticket exhibition changes are possible on the part of the airline. All flight times have to be reconfirmed by the airline at the earliest 72 hours before the respective flight date. It is also important to note that you must arrive at the counter of the airline no later than two hours before departure. For flight delays and delays, Taj Reisen is not liable, as far as these are not due to a fault of Taj Reisen, even if the airline has excluded their liability efficiently.
15. Connecting Flights
If you book additional connecting flights yourself or through a travel agency, please note that the flight times of the connecting flights indicate that the flight times of your holiday tour announced at the time of booking are only non-binding flight times and can be changed for a variety of reasons at short notice. For connecting flights after returning from your holiday, please bear in mind that flight delays of several hours must always be expected in today’s international flight traffic. We therefore urgently recommend that you consider a considerable amount of time when booking connecting flights and that it is best to choose a tariff that allows you to make changes at any time and free of charge.
The place of jurisdiction of Taj Reisen e.K. is in Hamburg, Germany. In the event that the contracting party of Taj Reisen does not have a general area of jurisdiction in Germany, or in the event that the party to be sued for damages moves its domicile or habitual residence out of the scope of this Act or their domicile or habitual home after the conclusion of the contract is not known at the time of filing of the claim, as well as in the event that the contractual partner for Taj Reisen is a registered trader, the place of jurisdiction is Hamburg, Germany. Both parties agree that our jurisdiction and the act refer to German law. German law governs the Contract and these Conditions. You consent to the exclusive jurisdiction of the Federal Republic of Germany.
17. Travel documents
The recipient of the travel documents is obligated to immediately check the received documents for the correctness of the exhibition (name, travel dates, travel destination, etc.) and to reclaim them quickly in case of faulty presentation.
18. Ineffectiveness of a travel condition
Should one of the above travel conditions be ineffective or inadmissible, this has no effect on the existence of the remaining travel conditions.
